1.1. By accessing or using the Factory Games LTDA website and/or registering an account for the game "RubinOT", you agree to these Terms of Service and all game policies and regulations, including our Privacy Policy and specific rules. By creating an account and/or downloading the game software, you confirm and warrant that you are at least 13 years of age.

1.2. This document sets out the terms under which Factory Games LTDA provides access to an account for you to play the online RPG "RubinOT".

1.3. If you do not agree with these Terms, do not use the "RubinOT" website or game. Acceptance or continued use of the site or game implies unrestricted acceptance, even tacit, of all the terms and conditions described below.

1.4. These Terms may be updated by Factory Games LTDA due to changes in applicable law, regulatory requirements, or by its own decision. The updated version will be available on the website, and continued use of the game or website after changes will constitute acceptance of those changes.

2.1. MINIMUM AGE REQUIREMENT: "RubinOT" requires users to be at least 13 years of age. By creating an account, accessing the website, or using any of our services, you declare and warrant that you are at least 13 years old.

2.2. PROHIBITION FOR CHILDREN UNDER 13: Access to "RubinOT" by individuals under 13 years of age is STRICTLY PROHIBITED. Children under 13 cannot create accounts or play the game under any circumstances.

2.3. RESTRICTIONS FOR USERS UNDER 18: Users between 13 and 17 years of age are allowed to play but are subject to the following restrictions: (a) Access to the roulette system and other mature content areas is blocked; (b) Daily playing time is limited to 6 hours, after which a mandatory 2-hour break is required before playing again; (c) Daily acceptance of terms is required when accessing age-restricted areas.

2.4. MATURE CONTENT (18+): Certain features of "RubinOT" contain mature content and are restricted to users aged 18 years or older. These include but are not limited to: (a) the roulette reward system; (b) certain in-game areas with adult themes. Users under 18 will be automatically blocked from accessing these areas.

2.5. LEGAL COMPLIANCE: These age policies are established in compliance with Brazilian legislation, including but not limited to: (a) Law No. 15.211/2025 (Lei Felca) - regarding the protection of children and adolescents in digital environments; (b) Law No. 8.069/1990 (Statute of the Child and Adolescent - ECA); (c) Law No. 14.790/2023 - regarding betting and gaming regulations; and (d) Law No. 13.709/2018 (LGPD) - regarding protection of minors' personal data.

2.6. CONTENT NATURE: "RubinOT" contains elements that parents should be aware of, including but not limited to: (a) fantasy violence and combat themes; (b) in-game chat and social interaction with other players; (c) virtual economy with optional real-money transactions.

2.7. IMMEDIATE ACCOUNT TERMINATION FOR CHILDREN: If Factory Games LTDA identifies or suspects that an account belongs to or is being used by an individual under 13 years of age, the account will be IMMEDIATELY and PERMANENTLY terminated without prior notice. All virtual items, currency, progress, and any funds associated with the account will be forfeited without right to refund or compensation.

2.8. AGE VERIFICATION: Factory Games LTDA may, at any time and at its sole discretion, request documentation to verify the user's age. Failure to provide such documentation or providing false information may result in immediate account suspension or permanent termination without right to refund.

2.9. FALSE DECLARATION: Providing false information about age during registration or at any other time constitutes a serious violation of these Terms and may result in: (a) immediate and permanent account termination; (b) forfeiture of all virtual items, currency, and progress; (c) legal action as permitted by applicable law.

2.10. PARENTAL RESPONSIBILITY: Parents and legal guardians are responsible for supervising minors under their care when using "RubinOT". Factory Games LTDA strongly recommends the use of parental control software and supervision of children's online activities.

2.11. COMPULSIVE USE WARNING: Prolonged exposure to video games may cause adverse effects on physical and mental health. We recommend taking regular breaks, maintaining healthy gaming habits, and seeking professional help if you or someone you know shows signs of gaming addiction. Users under 18 are automatically subject to playing time limits to help prevent compulsive use.

3.1. The game "RubinOT" is provided "as is", with no guarantees of continuous operation, absence of errors, or vulnerabilities. Factory Games LTDA offers no express or implied warranties of any kind, including but not limited to warranties of title, compliance, merchantability, or fitness for a particular purpose.

3.2. The use of the software is at your sole responsibility. Factory Games LTDA does not guarantee that the software, the game, or your account will function uninterrupted, error-free, securely, or free from viruses.

3.3. Factory Games LTDA is not responsible for unforeseeable events or acts of God that interfere with the game, such as technical failures, third-party attacks (e.g., hacking or DDoS), internet service interruptions, or other factors beyond the Company's control.

4.1. Factory Games LTDA is not liable for any loss of profits, data, special, incidental, or consequential damages arising from the use or inability to use the game, including the loss of items, accounts, or characters due to errors, system maintenance, or gameplay changes.

4.2. In accordance with Article 927 of the Brazilian Civil Code, Factory Games LTDA's liability for damages only applies in cases of intent or gross negligence, which do not fall within the nature of the service provided. The user assumes all risks inherent in the use of the game.

5.1. The user must comply with all "RubinOT" rules, available on the official game website. Failure to comply with these rules may result in account suspension or deletion, with no right to refund or compensation. The user's contractual obligations are subject to Articles 421 and 422 of the Brazilian Civil Code, which deal with the principles of good faith and the social function of the contract.

6.1. Factory Games LTDA complies with Brazilian data protection legislation, including the General Data Protection Law (LGPD - Law No. 13.709/2018). Users' personal data will be collected, stored, and processed solely for purposes related to the service and improving the experience in the game "RubinOT".

6.2. Factory Games LTDA is not responsible for damages resulting from security breaches caused by third parties or the user's negligence in safeguarding their access data, as provided in Article 43 of the LGPD.

6.3. NO COLLECTION OF MINORS' DATA: As "RubinOT" is strictly prohibited for individuals under 18 years of age, Factory Games LTDA does not knowingly collect, store, or process personal data from minors. In compliance with Article 14 of the LGPD and Law No. 15.211/2025, if we become aware that personal data has been collected from an individual under 18 years of age, such data will be immediately deleted and the associated account will be permanently terminated.

7.1. Factory Games LTDA does not commit to participating in conciliation, mediation, or arbitration procedures outside of the Judiciary. Any disputes arising from these Terms will be resolved in the Court of Sao Paulo/SP, and the parties expressly waive any other jurisdiction, however privileged.

8.1. By creating an account or using the website, the user agrees to the "RubinOT" Terms of Service and End User License Agreement.

8.2. These Terms represent the entire agreement between the parties and supersede any other agreement, verbal or written, regarding the use of the game "RubinOT" and the services offered.

8.3. Factory Games LTDA reserves the right to take legal action in the event of non-compliance with these Terms by the user.

9.1. The game "RubinOT" is an entertainment service, and the user acknowledges that any loss or damage arising from the use of the game cannot be attributed to Factory Games LTDA or its operators.

9.2. All users fully accept the risks associated with the use of the service, expressly waiving any claim for compensation against Factory Games LTDA, its representatives, or partners.

9.3. AGE CLASSIFICATION: "RubinOT" is classified for users aged 18 years and older. This classification is prominently displayed at the time of access and throughout the platform, in compliance with Article 8, V of Law No. 15.211/2025.
