These Terms of Service establish the conditions under which Factory Games LTDA provides "VIP Time", "Rubini Coins", and "Additional Services" (hereinafter referred to as "Paid Services") for the online RPG game "RubinOT". This document complements the "RubinOT Service Agreement", which all users must accept when creating an account.

1.1. "VIP Time" temporarily grants exclusive abilities and benefits to the account holder ("VIP Account") that are not available to free accounts. Factory Games LTDA reserves the right to add, modify, or remove such abilities and benefits at any time, respecting the principles of good faith and the social function of the contract in accordance with the Brazilian Civil Code. The VIP Account is for personal and non-transferable use, intended exclusively for the account holder.

1.2. "Rubini Coins" are virtual currency used to purchase exclusive products and benefits in the game's store. Factory Games LTDA reserves the right to add, alter, or remove products at any time. Depending on conditions and the payment method, Rubini Coins may be transferred between accounts, always in compliance with the security and compliance standards established in this contract.

1.3. "Additional Services" are special functionalities that assist in the management and administration of RubinOT accounts and are non-transferable between accounts.

Fees for Paid Services must be paid in advance, and the acquisition of these services is considered full acceptance of the conditions described herein. The prices charged are available on the official RubinOT website and may be changed by Factory Games LTDA at any time. Price changes apply only to future purchases after the new prices are announced.

2.2. Fees are non-refundable, in whole or in part, except in cases provided for by applicable law, such as in situations of proven technical failure or cancellation of the service within the legal withdrawal period (7 days, as per article 49 of the Brazilian Consumer Protection Code).

3.1. Accounts that remain inactive or unused for a period of two years will have all unused Paid Services canceled without the right to a refund. Factory Games LTDA reserves the right to deactivate such accounts, respecting the principles of transparency and good faith.

3.2. Upon the expiration of VIP Time, the account will automatically revert to free status, and all benefits associated with the VIP Account will be terminated. The user will be notified in advance of the impending expiration, allowing them to renew the paid services if desired.

4.1. The user has the right to cancel this contract within 7 days from the date of acceptance, without the need for justification, provided that the corresponding service has not been used, as provided in article 49 of the Brazilian Consumer Protection Code. The cancellation notice must be sent to Factory Games LTDA via email ([email protected]) in a clear and explicit format.

4.2. Once the cancellation is confirmed, all payments received will be refunded without unjustified delay, within a maximum of 7 calendar days, through the same payment method used by the user, ensuring the full exercise of their consumer rights.

5.1. The user is fully responsible for the security and protection of their login credentials (username and password) for their RubinOT account, as well as for activities performed under their ownership. It is recommended to use secure passwords and change them periodically.

5.2. Sharing, assigning, or transferring access information to third parties is prohibited. In case of suspected account compromise, the user must immediately notify Factory Games LTDA, which will take appropriate measures to protect the system's integrity.

5.3. Factory Games LTDA is not responsible for damages resulting from compromised accounts due to the user's negligence, including account sharing or exchange, in accordance with the principles of responsibility and care outlined in the Brazilian Civil Code.

6.1. The user must comply with the game rules ("RubinOT Rules"), which are available on the official website. Violation of such rules may result in temporary or permanent suspension of the account, without the right to a refund of paid services, in accordance with article 421 of the Brazilian Civil Code, which deals with the autonomy of contractual will.

6.2. Factory Games LTDA reserves the right to modify the RubinOT Rules at any time, informing users at least 30 days in advance in the case of substantial changes affecting the user experience, by mere notice in the "chat" available on the game's site/software.

6.3. In cases where mere indications of bot usage are detected by RubinOT gamemasters, after providing the User with an opportunity to explain the occurrence, RubinOT holds and will hold the unrestricted right to ban accounts with the sanctions provided in item "6.1", and the user will have no further recourse after providing their explanation, in any instance.

7.1. Factory Games LTDA will make reasonable efforts to keep the game and associated services running continuously and securely but does not guarantee uninterrupted or error-free operation. Maintenance, updates, and improvements may cause temporary service unavailability.

7.2. Factory Games LTDA assumes no responsibility for failures in internet connection, user equipment, or any other factors beyond its control that compromise access to RubinOT.

8.1. Factory Games LTDA is not responsible for financial losses, moral, material, or consequential damages resulting from the use or inability to use the game, including the loss of data, items, accounts, or characters. The limitations provided herein follow the principles of Brazilian law and articles 927 and 944 of the Civil Code.

8.2. The company disclaims any responsibility for indirect, incidental, or consequential damages that may arise from software failures, system interruptions, or gameplay adjustments, preserving the entertainment and enjoyment aspects of the platform.

9.1. These Terms are governed by Brazilian law, particularly the provisions of the Civil Code and the Consumer Protection Code. Any disputes arising from this contract shall be resolved in the jurisdiction of Sao Paulo/SP, with express waiver of any other jurisdiction.

10.1. Factory Games LTDA reserves the right to amend these Terms of Service, in whole or in part, at any time, to comply with current legislation, best market practices, or by its own decision. Changes will be communicated at least 30 days in advance through the official RubinOT website.

10.2. If any provision of this contract is deemed invalid or unenforceable by a competent court, the remaining provisions will remain in full force and effect, with the invalid provision being replaced by another that reflects the original intent as closely as possible.

10.3. By using Factory Games LTDA's services, the user expressly agrees to these Terms of Service, understanding their rights, obligations, and responsibilities, in accordance with Brazilian law.

10.4. By electronically accepting these Terms, the user acknowledges the legal validity and effectiveness of this instrument, in accordance with current legislation, as if it had been physically signed, confirming their commitment to all the established clauses.
