1.1. By accessing or using the Factory Games LTDA website and/or registering an account for the "RubinOT" game, you agree to these Terms of Service and all game policies and regulations, including our Privacy Policy and specific rules. Creating an account and/or downloading the game software confirms that you are of legal age according to the laws of your country or that you have permission from your legal guardians to do so.

1.2. This document sets forth the terms under which Factory Games LTDA provides access to an account that allows you to play the online RPG "RubinOT".

1.3. If you do not agree to these Terms, do not use the website or the "RubinOT" game. Acceptance and/or mere continuity in the use of the website or the game implies acceptance, even tacitly, of all the terms and conditions described below.

1.4. These Terms may be updated by Factory Games LTDA due to changes in applicable legislation, regulatory requirements, or by its own decision. The updated version will be available on the website, and the continued use of the game or website after changes constitutes acceptance of the changes.

2.1. The "RubinOT" game is provided "as is", without guarantees of continuous operation, absence of errors or vulnerabilities. Factory Games LTDA makes no express or implied warranties of any kind, including, but not limited to, warranties of ownership, compliance, merchantability, or fitness for a particular purpose.

2.2. Use of the software is at your sole responsibility. Factory Games LTDA does not guarantee that the software, game, or your account will function uninterruptedly, without errors, securely, or virus-free.

2.3. Factory Games LTDA is not responsible for events of force majeure or unforeseen circumstances that interfere with the game, such as technical failures, third-party attacks (e.g., hacking or DDoS), internet service disruptions, or other factors beyond the Company's control.

3.1. Factory Games LTDA is not responsible for any loss of profits, data, special, incidental, or consequential damages resulting from the use or inability to use the game, including the loss of items, accounts, or characters due to errors, system maintenance, or changes in gameplay.

3.2. In accordance with Article 927 of the Brazilian Civil Code, Factory Games LTDA's liability for damages only applies in cases of willful misconduct or gross negligence, which do not fall within the nature of the service provided. The user assumes all risks inherent to the use of the game.
